Dear Residents,
Election time is upon us again so a reminder about political signage. As per AZ. 33-1808, you may put up political signage 71 days prior to the primary election and through until 15 days after Election DAY regardless of the outcome of the election. AZ. 33-1808 distinguishes between political signage and Flags. Per Az. 33-1808 as an HOA "an association shall not prohibit the outdoor front yard or backyard display of any of the following... The American Flag, flown consistent with Federal Flag code (P.L. 94-344; Stat. 810; United States Code sections 4 through 10). The POW/MIA flag, an Az. Indian Nations flag, the Gadsden flag, any of the Armed Forces flags, First responder Flags and Blue or Gold service flag. ANY other flags are at the HOA's discretion to prohibit at any time. And according to our CC&Rs ONLY the above mentioned flags are allowed to be flown at any time.
Incidentally According to the above mentioned Public law section 12 #a states"The flag should never be displayed with the union down, except as a signal of dire distress in instances of extreme danger to life or property". This has been interpreted as "Imminent and immediate danger"
